Terms & Conditions
Interpretation
"Manufacturer" shall mean Kokkinos Labels Pty Ltd A.C.N. 006 131 531 A.B.N. 83 215 635 276, trading as Colourstone Melbourne and Colourstone Shanghai.
"Customer" shall mean the person, business and/or company's associates and/or employees who purchase or receive Goods from the Manufacturer
"Goods" shall mean invoiced products and services purchased by the Customer from the Manufacturer
“Order” shall mean any document or verbal approval confirming the purchase of Goods from the Manufacturer
“GST” shall have the same meaning as per the “A New Tax System (Goods and Services Tax) Act 1999”
 


Online Disclaimer
The Manufacturer cannot guarantee that email generated, or use of its website and its facilities are free of viruses or other conditions which may damage or interfere with the customer’s data, hardware or software. It is used on the strict condition that the Customer carries out and relies on its own procedures for ensuring that its use will not interfere with the their systems and the Customer assumes all risk of use and absolves the Manufacturer of all responsibility for any consequence of its use. Use of the Manufacturer’s website and its facilities, and/or submitting an Order to the Manufacturer signifies the Customer’s acceptance to the Manufacturer’s Terms and Conditions. All information and contents within the Manufacturer’s website are the property of the Manufacturer, and are subject to trademark and copyright laws. No material from this website may be copied, reproduced, downloaded, distributed, or transmitted in any way or form without written permission from the Manufacturer.




Conditions of Use
Use of this website and its facilities, and/or submitting an Order to the Manufacturer signifies the Customer’s acceptance to the Manufacturer’s Terms and Conditions. All information and contents within the Manufacturer’s website are the property of the Manufacturer, and are subject to trademark and copyright laws. No material from this website may be copied, reproduced, downloaded, distributed, or transmitted in any way or form without prior written permission from the Manufacturer.
 


Supplied Artwork
Artwork supplied by the Customer must be in accordance with the Manufacturer's Artwork Guidelines which are available from the Manufacturer’s website or from request. The Manufacturer will not be liable for discrepancies in finished Goods if artwork is supplied incorrectly by the Customer. The Customer may also be subject to additional artwork fees should artwork be submitted incorrectly.



Proofs and approvals
Colours generated on electronic, and digital proofs are not guaranteed to be 100% correct, and should only be used as a reference guide. It is the Customer's responsibility to inform the Manufacturer if a specific media, finish or colour matching system is required, with details clearly stated on their Order. Upon request, a pre-production sample can be produced for Orders (additional charges may be applicable). This can be supplied in either electronic or hardcopy format for approval by the Customer prior to production commencing. Once an approval is confirmed by the Customer for production, any un-noticed errors will be the responsibility of the Customer.
 


Order Confirmation
The Manufacturer is not obliged to process any Orders, and will notify the customer within approximately 2 working days of receiving the Order should it not be accepted.



Payment Terms
All prices quoted by the Manufacturer are subject to change without notice. Prices quoted may be subject to additional charges such as applicable taxes, delivery fees, exchange rate variances, customs fees and/or other handling charges. All additional charges will be borne by the Customer.
Trading terms of Goods for Customers without approved credit from the Manufacturer will be by upfront payment of invoice prior to commencing production of Goods. Additional costs may follow the initial transaction of Goods purchased and will be invoiced accordingly to the Customer.
Trading terms of Goods for Customers with approved credit from the Manufacturer are strictly net 30 days from invoiced date unless otherwise negotiated in writing. Goods are to remain property of the Manufacturer until the invoice is fully paid.
If payment of Goods is not received from the Customer within the trading terms, the Manufacturer reserves the right to retrieve the Goods from the Customer.
As a result of non-payment, the Customer will be liable for:

* Enforcement of additional account keeping fees at the discretion of the Manufacturer; and/or
* Expenses incurred by the Manufacturer in attempt to retrieve the Goods from the Customer; and/or
* Legal costs incurred by the Manufacturer in attempt to recover payment of the Goods.
 


Delivery
Goods delivered via a courier/delivery service not associated with the Manufacturer, will be issued with tracking reference number, which can be traced to indicate proof of delivery. The Manufacturer will not be liable for Goods lost if proof of delivery to the Customer can be supplied. The Manufacturer will make every attempt to deliver the Goods by the Customer's required delivery date, however the Manufacturer will not be liable for late delivery of Goods which exceed the quoted or requested delivery date. Once the Customer has received the Goods from the Customer, all risks for the Goods will be borne by the Customer.
 


Return and Claims
Goods may only be cancelled or varied if mutually agreed in writing between the Manufacturer and Customer. The Manufacturer will not be liable for print, weave, media, or colour variance for repeat Orders, as raw stock quality used to make products may either vary, or be limited to availability. Claims by the Customer for Goods supplied must be made in writing within 7 days from the date that the Goods were received.
It is the Customer's responsibility to ensure that:

* All relevant information and instructions relating to the Goods are stated in the Customer's Order;
* Goods received are in accordance with the information stated on the Customer's Order.
The Manufacturer will not be liable, or accept any claims for:

*Goods supplied that are in accordance with the Customer's requirements stated on the Customer’s Order;
*Incorrect Goods supplied that have been used by the Customer;
*Goods returned that are not in the same condition as originally supplied by the Manufacturer.

It is the Customer’s responsibility to ensure that Goods produced by the Manufacturer do not breach any Copyright laws, and the Customer indemnifies and will keep the Manufacturer indemnified against any liability, loss or expense suffered by the Manufacturer as a direct or indirect result of this.

In order to deliver the services you require, we may disclose your personal information to organisations outside of Colourstone. Your personal information is disclosed to these organisations only in relation to us providing our services to you.

* customer enquiries;
* mailing operations;
* billing and debt-recovery functions;
* market research; and
* website usage analysis.

We take reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.
In addition, we may disclose your personal information to:

* your authorised representatives or your legal advisers (e.g. when requested by you to do so);
* credit-reporting and fraud-checking agencies;
* credit providers (for credit related purposes such as credit-worthiness, credit rating, credit provision and financing);
* our professional advisers, including our accountants, auditors and lawyers;
* government and regulatory authorities and other organisations, as required or authorised by law; and
* organisations who manage our business and corporate strategies, including those involved in a transfer/sale of all or part of our assets or business (including accounts and trade receivables) and those involved in managing our corporate risk and funding functions (e.g. securitisation).
